Strategic Legal Counsel for Cannabinoid Product Businesses

In some states, emergency hemp regulations have replaced or supplement medical and/or adult-use cannabis product regulations, instantly changing the regulatory environment (and sometimes, without due democratic process). Additionally, the DEA has declared certain cannabinoid extracts, including hemp-derived cannabinoid THCO illegal, and the FDA is issuing warning letters to companies that market CBD and delta-8 THC. Tailored strategic guidance and compliance plans from the hemp compliance attorneys at Rudick Law Group safeguard your business operations within this ever-shifting regulatory landscape, and could prevent enforcement actions.

Rudick Law Group tracks developments in the industry and creates strategies for complying with or challenging emergency hemp regulations. With RLG as your compliance lawyer for delta-8 and other hemp-derived cannabinoids, your business is always one step ahead of emergency rules and fast-moving regulatory deadlines.

Labeling, Packaging, and Product Liability Protection

Various state regulations require hemp products to be packaged in child-resistant containers. Your state may also require disclosure about which cannabinoids are present in the product. However, hemp-derived cannabinoid products generally lack testing standards and significant quality control. This raises the possibility of contaminated products that could open your business to liability.

The legal experts at Rudick Law Group tailor our liability protection and compliance solutions to your business. We develop strategies that maximize both your protection from liability claims and the accuracy of your labeling and packaging.

Health Claims, Physician Marketing, and Federal Boundaries

The Federal Food, Drug, and Cosmetic Act bans the use of medical claims in marketing of hemp-derived cannabinoids. Similarly, the Federal Trade Commission (FTC) has taken action against CBD product sellers for claims it deems scientifically unsupported. Our regulatory compliance services at RLG include the review of marketing collateral to ensure that the marketing of hemp-derived products does not violate federal law or precipitate an FTC warning letter.

FAQ

Frequently Asked Questions About Cannabinoid Law

When did hemp cannabinoids become legal? Are they still legal?

Hemp was legalized under the 2018 Farm Bill, opening the door for the production of hemp-derived cannabinoids, including tetrahydrocannibinols, such as THC, delta-8 THC, and cannabidiols, such as CBD. However, the Food and Drug Administration (FDA) considers it unlawful to market and sell hemp-derived cannabinoids, until an appropriate new regulatory framework is implemented. More specifically, according to the FDA, it is unlawful to introduce cannabis to foods and/or to market cannabis products as dietary supplements. From the FDA’s perspective, cannabis should be regulated like medicine. And to this end, the FDA has approved just one prescription drug, Epidiolex, to treat specific seizure disorders.

Is Delta-8 THC legal to sell in my state?

Delta-8 THC is legal to sell in many states, though varying levels of regulations are common, such as restrictions on buyer age or sale location. In some states and Washington, D.C., delta-8 THC is banned, and in some it is highly restricted. When the federal appropriations rider takes effect in November 2026, Delta-8 will not be legal on a federal level and state legality will turn on compliance with applicable state law.

Can a CBD beverage brand face FDA enforcement action?

Yes, a CBD beverage brand can face FDA enforcement action. The FDA prohibits CBD from being added to any edible product and then sold across state lines, including CBD beverages. The FDA is most concerned about making medical claims when marketing CBD beverages and/or failing to inform consumers of cannabinoid exposures. Retaining a hemp-derived cannabinoid attorney, such as Rudick Law Group, may minimize your CBD beverage brand’s chances of facing FDA action.

How can I stay compliant when regulations change overnight?

To stay compliant in an ever-changing regulatory environment, you need tailored legal support, strategic guidance, and compliance services from a hemp-derived cannabinoid attorney on an ongoing and continuous basis. This is what we do at Rudick Law Group.

Do I need specific contracts with my suppliers or co-packers?

Yes, you need specific contracts with your suppliers or co-packers that address the unique business challenges associated with operating in the hemp market. For example, written contracts may minimize your company’s legal liability if a supplier or co-packer faces regulatory fines or other legal scrutiny, and they may ensure that your suppliers or co-packers hold up their end of the bargain. At Rudick Law Group, we work from a foundation of unparalleled legal expertise within the cannabis sector to develop robust contracts between your business and its suppliers or co-packers.
